Today’s interview is with David Wanetick, the CEO of IncreMental Advantage, LLC. David has valued thousands of patents for Fortune 100 companies, start-ups, mid-sized companies, university technology transfer offices, national laboratories, and hedge funds. David is active in monetizing patents. He is a Managing Director at JD Merit, and he developed and runs the Certified Patent Valuation Analyst designation. The CPVA program has been run all over the world for more than 12 years. Some 250 testimonials are available at the CPVA website. David is the author of seven books, including Plight of the Patentee: The Case for Restoring Inventors’ Rights; Solution Nation: One Nation is Disproportionately Responding to the World’s Most Intractable Problems; The Strategic Negotiator: A Manual for Negotiating at the Elite Level; and, Business Model Validation: What Makes Business Models Work.

Kidon IP War Stories: David Cohen & Sarah Matheson

In this session, we had a great conversation with Sarah Matheson. For over 25 years Sarah was a lawyer at Allens, a leading firm in Australia specializing in IP protection, commercialization, and litigation in pharmaceuticals, healthcare, engineering, mining, and telecom. Sarah led the Allens IP Group’s Healthcare Sector team and the innovation Action Group, among other roles. She always was very involved in Pro Bono work, including a large number of worthy clients and efforts. Sarah was a member of a number of Academic Advisory Boards in Australian law schools, and (among other roles there) Report General of the International Association for the Protection of Intellectual Property, A/K/A “AIPPI.”
On the nonlegal side, Sarah is the Chairman of the Board of the Australian Ballet School and a member of the Board of Trustees of the Royal Melbourne Hospital Neuroscience Foundation.
In all of these positions, Sarah has earned numerous awards and accolades, including being named “Global Elite Thought Leader for Patents”, “Lawyer of the Year for Life Sciences,” and featured in the Global Top 250 women in IP.
Our discussion focused on the arc of her career and insights on various trends in IP law in Australia and how they relate to various global trends. We also discussed some of her exciting non-legal work.
Kidon IP War Stories: David Cohen & Professor Daryl Lim

Today our guest is Daryl Lim. Daryl is the H. Laddie Montague Jr. Chair in Law at Penn State Dickinson Law and Co-Hire at the Institute of Computational and Data Sciences at Penn State University. He also serves as Associate Dean for Research and Innovation and founding director of the Intellectual Property (IP) Law and Innovative Initiative.
Professor Lim is an award-winning author, observer, and commentator of national and global trends in IP and competition policy and how they influence and are influenced by law, technology, economics, and politics. Among his many accomplishments, he is a founding member of the Global IP Alliance and its local chapters in Pennsylvania and Illinois. In addition, he serves as Co-Chair of the University Education Committee in the US IP Alliance. He consults and publishes internationally on various IP and antitrust issues. Among his previous accomplishments, Daryl headed the IP program at UIC Law from 2015 to 2022. And in no small part to Professor Lim, the IP program at UIC Law remains one of the most respected in the country. Also, since 2017, Professor Lim has convened the Annual IP Law Conference, now in its 65th year, and introduced the IP Leaders’ Roundtable, bringing together thought leaders of different persuasions to devise practical solutions to contemporary challenges in the IP world.
Our talk focuses on legal academia and IP and how it has changed for better and for worse over the past 20+ years. Daryl talks about how his outsider perspective has always informed his thinking on the law, and how his current efforts in academia are geared towards bringing together many perspectives on how one might solve key issues of the day.

Kidon IP War Stories: Douglas Clark, Principal and Global Head of Dispute Resolution

Our next guest is Douglas Clark, Principal and Global Head of Dispute Resolution.
Doug has practiced in Asia for close to 30 years. One might even say that he is the founding father or at the least a co-founding father of contentious IP disputes in East Asia. He is currently a solicitor advocate of the High Court of the Hong Kong SAR.
Doug is a keen IP strategist and negotiator — and having witnessed this myself on both sides, I can confirm it. He also is a master linguist of East Asian languages and a prolific author, including the first treatise of Hong Kong IP law and to my knowledge the only treatise on Chinese patent law written in English. He is also a co-author of a piece he, Eric Stasik, and I wrote on SEP licensing.
Don’t get me started about his extracurricular activities including being a movie producer, published legal historian, and law professor. Most importantly, he is a great guy with keen insights and is fun to hang out with.
Kidon IP War Stories David Cohen & Guan Huat Khoo

My next talk is with Guan Huat Khoo. I first met Guan Huat while at Vringo when I was developing a global SEP monetization campaign in which he and his firm played an important role.
Guan Huat is a litigator with over 30 years of experience, joining Skrine in 1993. He is frequently called upon to act as senior counsel, in both commercial and civil litigation and arbitration disputes. Guan Huat also advises both financial and non-financial institutions on regulatory and compliance matters. He is an adjunct faculty member of The ICLIF Executive Education Centre (part of Asia School of Business – in collaboration with MIT Sloan Management) and regularly speaks on its behalf on corporate liability and corporate governance matters. He has appeared as an expert witness on Malaysian law in several matters, including arbitration proceedings, in the United States and in Singapore. Guan Huat is one of the most highly regarded IP and Patent litigators in Malaysia.
Our discussion focuses on the IP system in Malaysia; how general and patent litigations are handled; and how the various global trends in IP and international trade impact the IP scene.

My next talk is with Otto Licks. I first met Otto while at Vringo when I was developing a global monetization campaign in which he and the firm played a key role.
Otto Licks is one of the founding partners at Licks Attorneys, one of, if not the leading Brazilian law firms with a global reach. Otto has a long and storied career, as an engineer, public servant, and now a top-notch litigator. Most importantly, Otto is a straight shooter who gets stuff done quickly AND is a great conversationalist and fun to be around.
Our discussion provides a brief overview of why Brazil should be an important part of IP strategy; some hot topics and trends in Brazilian IP and litigation; the amazing steps Otto and his firm took to cope with Covid-19; and a sprinkling of reminisces.
Kidon IP War Stories David Cohen & Richard Vary

My next talk is with Richard Vary. I first met Richard when I joined Nokia’s in-house IP litigation team in 2007. Richard had recently joined from a prestigious law firm in London. Richard worked his way up to ultimately become a VP and head of litigation at Nokia – where he oversaw some of their most successful and important litigation and licensing campaigns.
He is now a partner at Bird & Bird in London focusing on various international arbitration and litigation matters. Our discussion focuses on how little has changed, argument-wise, but how much has changed from a practical perspective in licensing disputes on patents that read on technical standards. We dive in deep pretty quickly but most listeners should be able to follow our discussion.

My next talk is my old partner in IP monetization, Bineet Bhasin. I first met Bineet in 2012 while I was at Vringo and he was at iRunway and we had an extremely fruitful and fun collaboration. Today Bineet is Vice President of IP Solutions at UnitedLex. His role includes managing revenue and defining the company’s go-to-market strategy for IP solutions. He works in close collaboration with GCs and Chief IP Counsels of leading corporations and their Outside Counsel to help them achieve better outcomes by reducing portfolio costs, generating licensing revenues, and driving the performance of the teams.
Our talk focuses on Bineet’s current work at UnitedLex and the role of analytics in crafting IP strategy.
Kidon Podcast: IP War Stories — David Cohen & John Geiringer

My next interview is a little different from the usual fare and is with my old friend John Geiringer. John is the regulatory section leader of the Financial Institutions Group at Barack Ferrazzano Kirschbaum & Nagelberg LLP in Chicago and concentrates on regulatory, governance, and investigative matters involving financial institutions. He also teaches banking law and regulation at Chicago-Kent College of Law’s Graduate Program in Financial Services Law and serves on the board of advisors of its Institute for Compliance.
As if that weren’t enough, John teaches national security law and is the founding Co-Director of its Center for National Security and Human Rights Law (and its Consortium for the Research and Study of Holocaust and the Law (CRSHL)). He is the editor of an upcoming book called “Countering the Financing of Terrorism: Law and Policy,” and the co-editor of an upcoming book involving the Holocaust and the law.
Our discussion runs through the key issues facing John’s clients today and rounds out with a fascinating discussion of the legal aspects of the sanctions currently being imposed against Putin’s regime for their actions in Ukraine. I hope you enjoy our fascinating conversation.

Dragos is an old comrade in arms from my Vringo days and was instrumental in helping develop and implement our strategy in Romania – which included the first European judgment affirming an SEP injunction under the European Court of Justice’s Huawei v. ZTE decision. Dragos has been and remains heavily involved in all aspects of the intellectual property and tech-startup scene in Romania. Indeed, Dragos, has been heavily involved in those spaces literally since just after Romania’s re-engagement with the Western world after the fall of Nicolae Ceaușescu.

Chris has also been a leading advocate for fractional / part-time / outsourced General Counsel. Through it all, Chris has taken an unusual (for an attorney) entrepreneurial approach to being a lawyer that is both fascinating and inspiring.

More importantly, as I have learned from working with Eric, is that he sharp, experienced, deeply knowledgeable about SEP licensing and telecom standards, fun to be around, and calls it like he sees it – but is always open to good arguments.
